Article 1. – Purpose and scope

The general conditions of sale detailed below govern the contractual relationship between ANNA FJORD, limited liability company registered under the number SIRET 44 190 443, with registered office at Galleri Anna Fjord – Engen 4 – 7620 Lemvig, Danemark (hereinafter referred to as “ANNA FJORD”) and any non-professional natural person (hereinafter referred to as “the ‘Client’) in the context of the online sale of its ready-to-wear clothing collections, as well as customs made clothing  from the website www.annafjord.com.

The site allows Anna FJORD to offer for sale ready-to-wear clothing collections, as well as customs made clothing to clients browsing the site.

The fact for the Client to order on the website implies full and complete acceptance without any exception nor reserve of these general conditions of sale.

These general conditions of sale are the only ones applicable and replace all other conditions, they then will prevail over all other conditions appearing in any other document, except prior, express and written derogation.

ANNA FJORD reserves the right to modify or adapt them at any time without notice.

The modified or adapted version is enforceable from the time it is posted online and is exclusively applicable to purchases made after it is put online, the user of the website being therefore invited to consult them systematically, before any new purchase.

Each purchase on the site is governed by the general conditions in force on the date the order is placed. 

The Terms and conditions of sale in force can be consulted and downloaded at any time on the website www.annafjord.com .

In the event of non-compliance by the Client with the terms of these T&Cs, ANNA FJORD reserves the right to take any measure likely to protect its interests and ensure their execution.

The Client declares to have read these general conditions and to have accepted them by ticking the box provided for this purpose before implementing the online order.

Article 2. – Products

The ready-to-wear and customs made clothing offered by ANNA FJORD comply with the standards applicable in France.

The offers presented on the website www.annafjord.com are valid within the limits of available stocks.

The elements illustrating and/or accompanying the said offers (such as in particular photographs) are given for information only and do not engage the responsibility of ANNA FJORD.

Assuming the existence of differences between the photographic representations appearing on the website and the products delivered, these in any case will not relate to their essential characteristics.

Article 3. – Orders

3-1 Quality of the Client

– The Client must be over 18 years old and must have full legal capacity 

– The Client must be a non-professional natural person acting in a personal capacity and not as a trader

3-2 Online ordering process for ready-to-wear clothing

The Client has the possibility of placing his order online via the link “SHOP – Order online” on the home page of the site, within the limit of available products.

To confirm an order, once the product(s) selected in the shopping cart have been chosen by size, color and quantity, the customer must:

– Accept these General Conditions and terms by ticking the corresponding box, provided for this purpose on the summary page of the Client’s order 

– Create or use an existing account: Fill in his/her name, a valid email address, a delivery and billing address if different, (the client being responsible for the consequences arising from false or inaccurate information transmitted or whose recovery would be unlawful).

– Choose a delivery method,

– Confirm the content of the order via the summary which allows the client to modify it if necessary

–  Choose and validate the payment method.

The sale will be considered final only after receipt by ANNA FJORD of the full price.

An order confirmation will then be sent to the Client by e-mail.

ANNA FJORD reserves the right to cancel any order from a client with whom there is a dispute relating to the payment of a previous order.

The cancellation of the order for this product and its possible refund will then be made.

For any question relating to the follow-up of an order, the Client can contact ANNA FJORD via the contact form or by email at the following address anna@annafjord.com .

It is understood that any order placed with ANNA FJORD is exclusively and strictly intended for the personal use of the Client, who therefore refrains from any partial or total resale of the products concerned since the site does not allow the purchase of goods for resale.

Orders must not exceed 20 products per order.

ANNA FJORD also reserves the right to refuse any order of an abnormal nature. 

Made-to-measure items can only be ordered at the Atelier, prior appointment being nevertheless possible online according to the process below.

3-3 Online Appointment Process for Ordering Custom Clothing

It is not possible to order made-to-measure items online, as it necessarily requires a prior appointment at the Workshop:

Possibility to request a provisional quote online

It is possible nevertheless to request a provisional quote in advance via the dedicated form under “contact quote” by entering your name, email address, and if possible, the type of item and the desired size.

Possibility of making an appointment at the Workshop online

It is possible to make an appointment at the workshop by telephone on (+33) 06 29 83 11 46 or via the “make an appointment” link, on the dates and times offered online, subject to providing your name, email address and to confirm,

The other steps (the Appointment, the Quote, the Payment, the Fitting, the Withdrawal), being carried out physically at the Workshop.

Article 4. – Price

The price displayed is expressed in Euros, all French taxes included (VAT in force at the time of your order and applicable according to the nature of the product), excluding processing and shipping costs.

 The shipping costs are the postal rates in force on the date of the order and will be indicated in the Client’s basket, before the final validation of the order.

For products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes.

Any customs duties or other local taxes or import duties or state taxes will be the sole responsibility of the Client, both in terms of declarations and payments to the authorities and/or competent bodies of the country concerned.

It is understood that the products ordered will remain the property of ANNA FJORD until full payment of the price by the Client including shipping costs.

Article 5. – Payment

The price of ready-to-wear items is payable in full on the day of the order.

Several payment methods are possible:

Article 6. – Delivery

After confirmation of the order and full payment of the price, ANNA FJORD undertakes to send all the references ordered by the Client to its carrier, the Post Office or Colissimo, who will deliver them to the address indicated within the deadlines mentioned during the order, including the processing time of the order and delivery of the product(s).

ANNA FJORD delivers its Products in France and abroad.

The products are sent with the delivery note, to the delivery address indicated by the Customer when ordering.

The delivery times indicated on the site are indicative times, corresponding to the average processing and delivery times.

In order for these deadlines to be respected, the Client must ensure the accuracy of the data transmitted during the order (such as, in particular: street number, building number, staircase number, access codes, names and/or or intercom numbers, etc.).

Please be aware that your personal data can be corrected or modified at your convenience by updating the data in your online account. All order will be delivered to the address confirmed on the summary page during the payment confirmation process

In the event of an error in the information provided by the Client, and in particular in the wording of the recipient’s contact details, ANNA FJORD cannot be held responsible for any resulting delays or delivery failures.

It is understood that any possible delay will not give rise to any right to damages.

As stipulated in article 4, with regard to deliveries outside mainland France, the Client agrees to pay all taxes due on the importation of products, customs duty, value added tax, and all other taxes due under the laws of the receiving country.

Article 7. – Delivery

In accordance with the legal provisions in force the Client has a period a fourteen days (14) from the date of receipt to exercise his right of withdrawal from ANNA FJORD, without any justification or penalty provided that the products are returned in their original condition neither worn nor washed within fourteen days (14) following the notification of the withdrawal decision.

Products that are damaged, soiled or incomplete will not be taken back.

The products must be returned in their original packaging to the following address:

If the conditions are met, ANNA FJORD will refund the Client’s order, excepting delivery and return costs.

Article 8. – Product conformity

ANNA FJORD undertakes to reimburse or exchange products that are visibly damaged or damaged or that do not correspond to the order placed by the Client, within the meaning of article L.217-5 of the consumer code, subject to this last, to make a detailed statement in writing via the online contact form or by email to the following address anna@annafjord.com  upon receipt of the products and to return the product within a maximum of 30 working days.

Upon receipt of the product, ANNA FJORD undertakes to reimburse the sums paid by the Client, including the shipping costs, within the time limits and forms provided for in Article 8.

The Client also benefits from the legal provisions relating to the guarantee against hidden defects mentioned in point 13.

Article 9. – Reimbursement

It is understood that the refunds referred to in Articles 7 and 8 above will take place within a maximum period of 20 days following receipt of the product, on the bank card used for payment or by bank check sent to the name and billing address provided. by the Client.

Article 10. – Intellectual property

The Purchaser expressly acknowledges the ownership of ANNA FJORD on the content of the site and in particular on the copyrights, trademarks, domain names, designs and models and other intellectual property rights appearing therein, any reproduction, imitation, representation or distribution of all or part of the Site or one of its elements, in whole or in part, in any form whatsoever, in any manner whatsoever, without the express and prior authorization of ANNA FJORD, being likely to constitute counterfeiting, an offense provided for and punished in particular by articles L.716-1 and L. 335-2 and following of the Intellectual Property Code.

Amongst the aforementioned intellectual property rights, of which the company ANNA FJORD is the owner, appear in particular and without limitation:

– The corporate name ANNA FJORD,

– The ANNA FJORD brand

– The domain name annafjord.com,

– All of the products offered, illustrative photographs, texts and captions under design rights and/or copyright.

It is understood that acceptance of these General Terms and Conditions of Sale does not imply assignment and/or operating license in whole or in part of the aforementioned intellectual property rights.

The Client is therefore prohibited from any imitation, reproduction of the products themselves and of any other element of the website for any reason whatsoever, on any medium whatsoever, by any means whatsoever.

Article 11. – Alternative Dispute Resolution – Mediation

In accordance with the provisions of Articles L 611-1 and R 612-1 and following of the Consumer Code, when the Client has sent a written complaint to ANNA FJORD in order to find an amicable solution and has not obtained satisfaction or a response within two months, he can use the online dispute resolution system accessible by clicking here: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.

He can also submit his complaint free of charge to the consumer mediator within a maximum period of one year from the initial complaint.

In accordance with the provisions of Articles L611-1 and R 612-1 and following of the Consumer Code, ANNA FJORD has set up a consumer mediation system, the chosen mediation entity being: “Centre de médiation et d’arbitrage de Paris” (https://www.cmap.fr/)

Article 12. – Disputes

All orders are subject to French Law and the jurisdiction of French Courts.

Any order automatically entails the Buyer’s acceptance of these general conditions of sale.

In the event of a dispute, the parties undertake to seek an amicable solution, before any legal action, in accordance with the procedures provided for in the article 11.

It is understood that ANNA FJORD cannot be held liable for damages of any kind, whether material, immaterial or bodily, which could result from misuse of the product(s) by the Client and from cases of force majeure. or incidental mentioned in point 13 below.

Article 13. – Guarantee and liability

The Client benefits from the legal guarantee of eviction and hidden defects provided that the use has been normal, and that the maintenance advice has been followed. 

In the event of a hidden defect proven by the Client, ANNA FJORD must repair all the consequences under the terms of articles 1641 and following of the Civil Code.

ANNA FJORD has, for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services, only an obligation of means.

It cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any case of force majeure, in accordance with the law and to case law.

In particular but not limited to, the following events which are considered as cases of force majeure releasing the seller from its obligation to deliver within the meaning of article 1218 of the Civil Code : war, riot, fire, floods, event of disruption or total or partial strike in  particular of postal services and means of transport or communication, accidents and any other irresistible events, external to the parties, unforeseeable, usually inevitable upheld by case law.

Article 14. – Transfer of ownership -transfer of risks

The transfer of the ownership of the products to the Client will be made after the payment of the price by the Client, regardless of the date of delivery.

In accordance with the provisions of Article L.216-2 of the Consumer Code, the transfer of the risks of loss and deterioration relating therefore will only be carried out when the Client takes physical possession of the Products.

Article 15. – Legal information

Personal data essential to the processing, delivery of orders and the establishment of invoices, must necessarily be provided by the Client on the site www.annafjord.com .

Otherwise, the order cannot be validated.

The Client also has a right to access, modify, rectify, and delete personal data at the following address: ANNA FJORD, Galleri Anna Fjord – Engen 4 – 7620 Lemvig, Danemark, all information relating to compliance with the General Data Protection Regulation (EU Regulation 2016/679) by ANNA FJORD being available on the website www.annafjord.eu on the page (link to “Privacy Policy”).
